Congress Delays Ban on Hemp THC Products Until December

Federal spending bill pushes enforcement to Dec. 11 following White House intervention.

The U.S. House of Representatives has passed a federal funding measure that delays a pending ban on hemp-derived THC products until December 11. The bill, which passed the Senate in August and now heads to President Donald Trump to avert a government shutdown, grants the commercial hemp market a temporary reprieve from federal prohibition.

Congress initially introduced the ban last year following pressure from law enforcement agencies concerned about minors buying unregulated intoxicating hemp products at convenience stores. The latest legislative move extends the grace period by an additional 30 days.

White House Backing and Medical Access Arguments

House Republicans inserted the 30-day delay into the must-pass spending legislation at the request of the White House. President Trump previously highlighted the utility of medical cannabis for seniors and military veterans managing chronic pain, stating that Congress should delay the ban "to ensure that Americans can continue to access the full-spectrum CBD products they have come to rely on, and that help them."

White House spokesman Kush Desai stated that the administration is working toward balanced oversight: "The only interest guiding the Trump administration’s decision-making is the best interest of the American people, and the Administration continues to explore a Gold Science Standard-based framework on hemp to expand treatment options for American veterans and patients."

Industry Response Versus Public Safety Concerns

The delay has drawn sharp criticism from anti-cannabis lawmakers who warn that the grace period allows intoxicating products to stay on retail shelves. "This is all about allowing gas station weed to continue to be available to our children and poisoning them," stated Representative Andy Harris (R-Md.). "I get it. They’re making billions of dollars on it... It’s bad policy."

Since the passage of the 2018 Farm Bill, hemp-derived THC has grown into a $28 billion sector. Industry leaders view the 30-day pause as an opening to establish product safety standards rather than a total prohibition.

Chris Lackner, president of the Hemp Beverage Alliance, noted that stakeholders want clear market regulations that address bad actors selling candy-like items to minors. "That is a crucial month and a lot can happen in that time. We do feel like there is an opportunity here," Lackner said. "What we all want to see is a regulatory framework that works for everyone, protecting public health and allowing the hemp beverage category to thrive."
