    South Korea Reclassifies E-Cigarettes as Tobacco to Close Legal Loophole

    The South Korean government has announced a legal revision effective April 24 that reclassifies all nicotine-based products, including synthetic nicotine e-cigarettes, as tobacco products. This move closes a longstanding loophole, subjecting liquid vapes to the same strict regulations as conventional cigarettes regarding advertising, packaging, and public use.

    The Health and Welfare Ministry has confirmed that all nicotine-based products will be legally reclassified as tobacco products starting April 24.     Closing the Regulatory Gap

    Previously, certain e-cigarettes and vape juices, particularly those using synthetic nicotine, fell into a legal gray area. The new revision expands the definition of tobacco to include any product made from nicotine, regardless of its source. This ensures that liquid e-cigarettes now face the same scrutiny as traditional tobacco.

    New Compliance Requirements

    Under the National Health Promotion Act, all nicotine products must now adhere to strict standards:

    • Packaging: Mandatory health warnings must be displayed.
    • Advertising: Promotion is tightly restricted; labels for flavored products that attract youth are banned.
    • Vending Machines: Only licensed retailers can install them, and they must have adult-authentication devices and be located in adult-only zones.

    Enforcement and Penalties

    The government is serious about enforcement. Violations, such as improper advertising or failure to display warnings, can lead to fines of up to 10 million won (approx. RM34,200) or one year in prison. Additionally, using liquid e-cigarettes in designated non-smoking areas will incur a fine of 100,000 won.
